Terms of Service

These terms are an agreement between you and Alexander Zmirich, doing business as Optimal Zenith (“Optimal Zenith,” “we,” “us”). They cover your use of optimalzenith.com and any coaching program you buy from us. By using the site or buying a program, you agree to these terms. If you do not agree, do not use the site or buy a program.

1. Who can use our services

You must be at least 18 years old to buy a program. By buying, you confirm that the information you give us is accurate.

2. What we provide

Optimal Zenith provides remote fitness and nutrition coaching. What each program includes is described on the programs page at the time you buy. Coaching is delivered online through meetings, messages, and written plans. There are no in-person sessions.

3. Health and safety

Optimal Zenith is not a medical provider. Our coach is a NASM Certified Personal Trainer and NASM Certified Nutrition Coach, not a physician or a registered dietitian. Coaching is general fitness and nutrition guidance. It is not medical advice, diagnosis, or treatment, and it does not replace care from a licensed health professional.

Talk to your doctor before starting any exercise or nutrition program, especially if you are pregnant, have a medical condition, take medication, or have had an injury.
Tell us about any injury, condition, or limitation before you start and whenever it changes.
Stop exercising and get medical help if you feel pain, dizziness, shortness of breath, or anything else that concerns you.
Exercise carries a risk of injury. You choose how and where you train, and you accept the risks of doing so.

Results depend on many things outside our control, including your effort, sleep, health, and how closely you follow the plan. We do not guarantee any specific result.

4. Billing and automatic renewal

All programs are monthly subscriptions. Payments are processed by Stripe. When you check out, you are charged the monthly price for your program, and you are charged the same amount on the same day each month after that until your subscription is cancelled as described below. Prices are shown on the programs page and at checkout.

If we change the price of a program, we will email you at least 30 days before the new price applies to you. You can cancel before then if your minimum commitment has been met.

If a payment fails, we may pause your coaching until the payment goes through.

5. The 3-month minimum

Every program has a minimum commitment of three monthly payments. You can stop using the coaching at any time, but if you ask to cancel before three monthly payments have been made, the rest of the minimum is still owed. In that case we will keep billing on the normal monthly schedule until the third payment, and then end your subscription.

6. How to cancel

After your third monthly payment, you can cancel at any time. Email optimalzenith@gmail.com from the email address you used at checkout and ask to cancel. That link opens a ready-made cancellation email. We will confirm your cancellation by email. Cancellation stops future charges. Your coaching continues until the end of the month you have already paid for.

7. Refunds

Payments are not refundable, including for partial months, except where the law requires a refund. If we end your coaching early for a reason that is not your fault, we will refund the unused part of any month you have paid for.

8. Your responsibilities

Give accurate information about your health, history, and progress.
Keep your contact and payment details up to date.
Treat coaching communications respectfully.

We may end coaching for abusive conduct or misuse of our materials. If we do, section 7 applies.

9. Our materials

Training plans, nutrition plans, guides, and other materials we provide belong to us. They are for your personal use. Do not resell, publish, or share them.

10. Website content

The guides and other content on this site are general information. We try to keep it accurate, but it may not fit your situation and may change without notice.

11. Disclaimer

Except as stated in these terms, the site and our services are provided “as is,” without warranties of any kind, to the fullest extent the law allows.

12. Limitation of liability

To the fullest extent the law allows, we are not liable for indirect, incidental, or consequential damages, and our total liability for any claim related to the site or our services is limited to the amount you paid us in the 12 months before the claim. Nothing in these terms limits liability that cannot be limited by law.

13. Third-party services

We rely on outside services such as Stripe for payments. Your use of those services is also covered by their own terms. Links to other sites, including our social media, are provided for convenience.

14. Governing law

These terms are governed by the laws of the State of Florida. Any dispute will be handled in the state or federal courts located in Florida, unless the law where you live gives you the right to bring a claim elsewhere.

15. Changes to these terms

We may update these terms. The current version and its effective date are always on this page. If a change materially affects an active subscription, we will email you before it applies to you.
